Who may use fofiy, what you may publish, and — just as important — what fofiy is not.

1 · What this is

This is the agreement between you and fofiy, operated from Cannes, France. Using the app means accepting it. It sits alongside the privacy policy, which describes what is held and for how long, and which is part of this agreement. If you do not accept both, do not use fofiy.

2 · Eighteen

fofiy is closed to people under 18. The year of birth is asked once, at the door, and it is a condition of the record itself rather than a checkbox to tick — an account cannot exist without an answer that clears 18. Lying about it is a breach of this agreement and the account will be removed.

3 · What fofiy is, and what it is not

fofiy is one account for three parts of real life: the people around you, the objects that change hands, and the work between businesses and creators.

fofiy On answers one question: who at this place, right now, is open to company.

Each surface answers its own question and this contract promises no more than that. fofiy On answers the one above. Poudrose answers a second: what somebody is selling — their own object, opening at €1 in public — and what a shop is selling, at the shop’s own price. Pacrea answers a third: what a business wants to happen and which creator can do it. Creators can apply now; the business side opens when payments do. The rest is worth being precise about, because each of these is a decision built into the product rather than a promise in a document:

• It is not an introduction service and it vets nobody. A verified phone proves somebody received a message. A verified identity document proves a provider believed the document — that a name is real, not that a person is safe. Neither is a recommendation, and neither is a check on anybody’s history or intentions.
• It does not sell tickets. Where an event has a ticket, fofiy links to whoever sells it and takes no part in that sale. There is no wallet and no balance.
• It does not arrange accommodation, and it is never a party to a stay. A trip is a city and two dates. An offer to host a traveller for the day is answered in a public place, has an end time, and may not run more than ten hours. Staying the night is a separate thing: both people must have had an identity document checked, a request is at most fourteen nights, and the address reaches exactly one person — the guest of a request you accepted, around those nights and no other time. No money passes through fofiy, nothing is booked instantly, and what you agree with a host you agree with them and not with us.
• It does not broadcast where you are. Presence belongs to a place you are standing in and it expires. Nothing tells anyone where you have been.
• It holds nobody’s money. A shop’s product is the shop’s, at the shop’s price: fofiy links out and is paid a commission by the shop, not by you. An auction of somebody’s own object has no settlement yet — nothing in Poudrose takes a payment today.
• It is free for people. Venues pay for a partnership under a separate written agreement; nothing in the app charges you, and no feature is behind a payment.

4 · Your account

You sign in with your email address and there is no password, so whoever can read your inbox can open your account — keep it as you would keep a key. One account per person. You are responsible for what is done from it. Tell us at hello@fofiy.com if you think somebody else has got in.

An invitation is a recommendation, not a key. Somebody already here spends one on you and it is recorded; there is no open sign-up and no waiting list to join. Everybody has one invitation at a time and the next arrives on a fixed interval — it is not earned, and there is no rank, level or score here that could earn it. An invitation you spend does not come back, including if the account it opened is later removed; that is not a penalty, it is why there is one at a time. Nobody is answerable for what the person they invited goes on to do. Selling or trading an invitation is not allowed, and it is the one thing that costs the person who did it their own.

Everybody joins the same way, and it is the application. Five people who know you each confirm that they do, and then a person reads the application. An invitation from somebody already here does not open the door — since September 2026 it is a reference: it records who suggested you and is shown to whoever reads your application. There is one way in and everybody comes through it. Four things are true of it and are worth saying plainly: five confirmations complete an application, they do not open the door — nothing here is granted automatically; the cards go out from your own phone, because fofiy sends nothing to people who are not on it; the details you write for those five stay on your device and never reach us, apart from a first name and a one-way hash; and we are not obliged to accept an application, nor to say why one was not taken forward. Applying costs nothing and you may withdraw at any point before it is decided.

5 · Meeting people, which is the whole point

fofiy exists to get you from a screen to a table, and that is exactly where its responsibility ends and your judgement begins. fofiy does not check anybody's identity, history or intentions, and cannot. So:

• Meet in the public place the request was about. Almost every part of the product is built for that — a day host is answered in public, an open-ground meeting point is chosen between the two of you somewhere visible, and no screen ever summons you anywhere.
• Tell somebody where you are going if that is what you would normally do.
• Leave whenever you want to. Declining a request, ending a conversation and turning fofiy Off need no explanation and the other person is not told why.
• Staying the night is the exception, so treat it as one. You will be in somebody’s home rather than at a table you can walk away from. Read the references — they are written by people who actually stayed, and they are permanent. Exchange enough messages to know who you are meeting. Give the address to somebody who is not on the trip. And leave at any hour, for any reason, owing no explanation to anybody.
• If somebody frightens or harms you, block and report them. If you are in danger, call the emergency services — in France, 112.

6 · How to behave

One rule, and the rest follows from it: the person at the next table is a person. Concretely, do not use fofiy to

• harass, threaten, stalk or intimidate anybody, or keep asking after a no;
• pretend to be somebody else, or use a photo that is not of you;
• publish anything sexual, hateful, violent or illegal, or anything involving a minor;
• turn a presence, a request, a conversation or anything you publish into a sales channel — no advertising, no recruiting, no promoting. Poudrose is where selling happens and it is the only place: an object of your own, opening at €1 in public, under section 3;
• photograph or name a person who has not agreed to it — a tag stays invisible until the person accepts it, and that is the standard, not the limit;
• collect other people's data, scrape the app, or automate it;
• claim to be somewhere you are not, or try to get around a check-in, a geofence or a rate limit.

7 · Places you add

A place may be added by whoever is standing in it — proven the same way a check-in is proven, because being there is better evidence about a place than a phone number is. A new place is provisional: it appears to nobody but its author and whoever is inside its fence until two different people have been present. Names are not moderated, because "has anybody else been there" is a question with an answer. Adding a place gives you no rights over it, and a place is not a business listing.

8 · Venues, Faces and clubs

A venue partnership is a separate written agreement and nothing in this document creates one. Two consequences worth stating plainly:

• A Face is paid in perks, never in money. A venue publishes an open call and a regular answers it; the venue pays fofiy, fofiy pays nobody, and a Face may not review the venue they represent. Whether the arrangement is disclosed follows from the dates of the partnership, so ending one cannot un-disclose the past.
• A club belongs to a person, not to a venue. A venue being a club's home grants it nothing: no roster, no rename, no say. An owner who wants to leave must hand the club to somebody first.

9 · What you publish stays yours

You keep every right in your photos, posts and reviews. You give fofiy permission to store and show them inside the product, to the people the product shows them to, for as long as you leave them up — nothing wider, and never for advertising. Delete something and the permission ends with it. We do not licence your content to anybody else and we do not train anything on it.

Reviews must be your own experience of a place you were actually at. A review bought, traded or written about a venue you represent is not a review.

A topic is a public room, and what you write in one is public. Anybody can read it — signed in or not — and so can a search engine, which is the point of a subject that outlives the day rather than a side effect. The composer says so before you type, and it is the one place on fofiy where that is true: everything else you publish is shown to the people the product shows it to and no further. It is still yours under the paragraph above, and deleting it still ends the permission; what deleting it cannot do is reach a copy somebody else already made of a page that was public when they read it.

10 · When we step in

fofiy is small and there is no moderation team watching. What exists instead is a report button, a block that is immediate and total, and rate limits that stop the same behaviour from scaling. Where a report shows a breach of section 6, we may remove content, close an account, or refuse a new one. Where somebody is in danger we will co-operate with the police. We will tell you why, unless telling you would put somebody else at risk.

You can close your account at any moment and take everything with you; see the privacy policy for what deletion removes and what survives it.

11 · No promise that it works

fofiy is offered as it is. It may be unavailable, a place may be missing, a count may be wrong, a message may not arrive. We do not promise it is fit for any particular purpose and we do not promise it is uninterrupted. Nothing here removes the rights French consumer law gives you, which override this section where they conflict with it.

12 · What we are answerable for

fofiy is answerable for harm it causes by its own fault. It is not answerable for what another person does — before, during or after a meeting arranged through it — nor for anything a venue does, nor for what you decide once you are at the table. Where the law allows a limit, our liability is limited to the direct damage caused and, since fofiy is free for people, to a nominal amount. Deliberate fault and personal injury are never limited, because the law does not allow it and they should not be.

13 · Changes

If this document changes in a way that affects what you may do or what you are owed, the date at the top changes and the app says so once. Continuing to use fofiy after that is acceptance. If you would rather not, close the account — nothing is lost that we hold on to.

14 · Law and courts

French law applies. If we cannot settle something between us, write to hello@fofiy.com first — most things end there. Failing that, the courts of France have jurisdiction, and as a consumer you keep the right to bring the matter before the courts where you live.
